Chapter I. General Provisions

Article 1 (Purpose)

The purpose of these Terms of Use shall be to set forth the conditions and procedures for use of the Trilateral Youth Exchange Network (TYEN) website (this “Website”), the rights, obligations, responsibilities of the Member (as defined below) and any other necessary matters with respect to any and all services provided by this Website.

Article 2 (Posting and Amendment)
  • 2.1_This Website shall post these Terms of Use on the service page of this Website for easy access by the Member.
  • 2.2_This Website may amend these Terms of Use to the extent not in violation of the Act on the Regulation of Terms and Conditions and the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.
  • 2.3_The use of this Website by the Member after registration shall be deemed consent to these Terms of Use, which shall, if the Member agrees to these Terms of Use, take precedence over any other terms or rules with respect to our provision of the Service and the Member’s use of the Service.
  • 2.4_In case of any addition to, deletion of or revision of this Policy, TCS will notify thereof on the website, mobile homepage or application, or by e-mail, etc. registered with TCS by the information subject.
  • 2.5_An amendment to these Terms of Use which is material or disadvantageous to the Member shall be notified to and obtain consent from the Member. However, the Member’s failure to respond within seven (7) days from the date of the notice shall be deemed consent to the amendment. This Website will provide the Service as before the amendment of these Terms of Use to the Member who refused the foregoing consent but, if provision of separate Service is provided to the Member who has not consented to the amended Terms of Use, this Website may not provide the Service to such Member or may terminate such Member’s membership.
  • 2.6_The Member may request to withdraw from membership if he/she does not agree to the amended Terms of Use.
  • 2.7_Any matters not provided for in these Terms of Use shall be in accordance with the Framework Act on Telecommunications, the Telecommunications Business Act, the Deliberation Regulations of the Information and Communication Ethics Committee, Information and Communication Code of Ethics, the Computer Programs Protection Act, and any other relevant laws and regulations.
Article 3 (Definitions)

The definition of the terms used in these Terms of Use shall be as follows:

  • 3.1_“Service” shall mean all services related to TYEN that the Member may use through this Website.
  • 3.2_“Member” shall mean a person who has registered as a member of this Website by providing the personal information required to register membership and thereby is allowed to use the information and Service provided by this Website;
  • 3.3_“Use Contract” shall mean the contract entered into between this Website and the Member for use of the Service;
  • 3.4_“Admission” shall mean the acts of providing certain information on the application form provided by this Website and of agreeing to these Terms of Use to complete the Use Contract for the Service;
  • 3.5_“User ID” shall mean an email address selected by the Member for identification and use of the Service;
  • 3.6_“Password” shall mean a combination of letters and numbers selected by the Member to verify the Member’s identity and protect the Member’s personal information on the network;
  • 3.7_“Withdrawal (termination)” shall mean the Member’s termination of the Use Contract;
  • 3.8_“Personal Information” shall mean information (including information which could easily be combined with other information to identify a particular person although the information itself may not be used to identify a particular person) about a live individual which can be used to identify a particular person such as name.
  • 3.9_“Post” shall mean texts, photos, video clips, and various files and links in the form of information such as codes, texts, voices, sounds, images and videos posted on the Service by the Member when using the Service.
  • 3.10_“Website Administrator” shall mean the person or the entity that operates and manages this Website and Service though this Website, and within the scope of this Terms of Use, it is the Trilateral Cooperation Secretariat (TCS); and
  • 3.11_Any terms not defined herein shall be defined in the relevant terms of use and usage regulations for individual Service.

Chapter II. Establishment and Termination of Use Contract

Article 4 (Execution of Use Contract)
  • 4.1_The Use Contract shall be established upon the agreement of the person who wishes to become the Member of this Website (“Applicant”) to these Terms of Use and this Website’s acceptance of the Applicant’s application for use.
  • 4.2_The Applicant may agree to these Terms of Use by ticking the “Agree” box on this Website.
Article 5 (Admission and Withdrawal)
  • 5.1_Admission into membership shall be established upon the Applicant completing the admission process by submitting a completed online application in the form provided by this Website.
  • 5.2_The following application by the Applicant or Admission by this Website may be rejected before Admission or cancelled after Admission:
    1. the Applicant applies in the name of any other person than the Applicant himself/herself;
    2. the submitted application contains false information;
    3. the Applicant applies for membership for the purpose of disturbing social order or good morals;
    4. the Applicant interferes with another person’s use of this Website or steals the information of another person;
    5. the Applicant commits any act prohibited by law and these Terms of Use in connection to using this Website;
    6. the Applicant previously lost membership under these Terms of Use (except in the case of obtaining approval for re-registration for this Website;
    7. the Applicant has not logged-in for one (1) year after membership registration;
    8. the approval is impossible due to reasons attributable to the Applicant or the application is made in violation of all other stipulated matters;
    9. a certain period of time set by this Website to prevent fraudulent registration has not elapsed after Withdrawal; or
    10. the applicant fails to qualify for membership for any other reason.
  • 5.3_In any of the following cases, this Website may postpone establishment of the Use Contract until the relevant cause is resolved:
    1. Service-related capacity is insufficient; or
    2. any other technical failure occurs.
Article 6 (Change of Member Information such as User ID)
  • 6.1_The Member may access and modify his/her Personal Information at any time through the Personal Information management menu. However, the gender, date of birth, User ID, etc., required for Service management may not be modified in principle.
  • 6.2_A User ID of this Website may be changed at the request of a Member or the TCS in the event of any of the following:
    1. the User ID consists of the Member’s telephone number or resident registration number and so is likely to result in a violation of privacy;
    2. the User ID is offensive to others or against public morals; or
    3. any other valid reason exists.
  • 6.3_The Member shall immediately inform this Website or update on-line of any change in his/her information registered by modifying his/her member information on this Website.
  • 6.4_This Website shall not be liable for any damages incurred by the Member for failure to inform the TCS of changes under Article 6.4.
  • 6.5_Other matters related to the management of and changes to the Member’s Personal Information shall be governed by this Website.
Article 7 (Consent to Use of Member Personal Information)
  • 7.1_The privacy policy of this Website shall apply to Personal Information of Member/Applicant. However, the privacy policy of this Website shall not apply to collection and use of Personal Information by websites linked to this Website.
  • 7.2_This Website strives to protect the Member’s Personal Information in accordance with relevant laws such as the Information and Communications Network Act and the Personal Information Protection Act.
Article 8 (Security of Member Information)
  • 8.1_Upon completion of the registration process on this Website, Members are responsible for keeping confidential the information they entered, and remain solely responsible for any consequences resulting from their disclosure, negligence or improper use of their User ID and password.
  • 8.2_Members are solely responsible for managing their User ID and password, and must immediately report any fraudulent use of their User ID or password to this Website and follow the instruction of this Website. Members will be held solely liable for any consequences resulting from their failure to report any such fraudulent use or incompliance with the instruction of this Website thereafter.
  • 8.3_Members must log out of this Website after using the Service. This Website shall not be held responsible or liable for any loss or damage caused by a Member’s failure to log out and any ensuing consequences (e.g. theft of Member’s information by third parties).

Chapter III. Use of the Service

Article 9 (Contents of Service)

This Website provides various services which allow registered users to connect with each other, such as, but not limited to, listing of other registered users and their voluntarily disclosed information, listing of events and listing of past activities.

Article 10 (Service Hours)
  • 10.1_The Service shall be available twenty-four (24) hours a day and seven (7) days a week, unless there is administrative or technical problems on this Website.
  • 10.2_This Website may set a particular date or time for regular inspection, during which the Service shall not be available.
Article 11 (Notice of Suspension and Change of Service)
  • 11.1_This Website shall not be responsible for a failure to store or transmit, or deletion of, any message intended to be stored by or transmitted to this Website or for loss of any other communication data due to any force majeure event, including, but not limited to, a national emergency, power outage, and service facility failure outside the management scope of this Website.
  • 11.2_If this Website needs to temporarily suspend the Service due to difficulties in providing the Service, the Service may be stopped after posting a notice of the reason for and date of suspension of the Service on this Website one (1) week prior to the Service suspension date. This Website shall not be responsible for any failure by a Member to read such notice. The above notice period may be shortened or waived in unavoidable circumstances. This Website shall also not be responsible for a failure to store or transmit, or deletion of, any message intended to be stored by or transmitted to this Website or for loss of any other communication data due to the above suspension of the Service.
  • 11.3_This Website may modify, change or suspend the Service with prior notice depending on operational and technical needs in case where there is a sufficient reason, for which this Website shall not be responsible to Members or any third party (more specifically, a Member or a third party shall not be entitled to any compensation) unless required by the relevant laws.
  • 11.4_This Website may temporarily suspend the Service without notice for unavoidable reasons such as urgent system inspection, expansion and replacement, and may completely shut down the Service for reasons deemed appropriate by this Website, such as replacement with a new service.
  • 11.5_This Website may restrict or suspend all or part of the Service in cases where it is impossible to provide the Service for reasons such as a national emergency, power outage, failure of Service equipment, or too much traffic, provided that this Website shall notify the Member of the cause and period of suspension before or after the suspension.
  • 11.6_This Website cannot provide prior notice for Service suspensions due to reasons outside the control of this Website (e.g. disk failure or system shutdown, etc. without willful misconduct of the system administrator), and shall not provide notice in the event of system shutdowns due to the willful misconduct of another person or entity (e.g. telecommunication companies, facilities-based telecommunication companies).
  • 11.7_This Website may divide the Service into specific ranges and specify the available time for each range individually with prior notice.
  • 11.8_This Website may unilaterally restrict or suspend a specific Member’s use of the Service or terminate the Use Contract if that Member breaches these Terms of Use. In such case, this Website may ban such Member from connecting to the Service.
Article 12 (Deletion of Posts or Content)
  • 12.1_The Website Administrator may delete any of the Posts posted or registered by the Member in the Service without prior notice if it is deemed to fall under any of the following cases without any liability whatsoever:
    1. Posts that slander or damage the reputation of the Website Administrator, other Members or third parties;
    2. Posts that are against public order and morals;
    3. Posts that are found to be related to criminal activity;
    4. Posts that violate copyrights or other rights of third parties;
    5. Posts inconsistent with the nature of the Service; or
    6. Posts that otherwise breach relevant law or regulations set by the Website Administrator.
  • 12.2_The Website Administrator shall have the right to edit, move or delete any Posts in the Service with three (3) days prior notice, and to delete, without prior notice, any Posts that are against these Terms of Use or contain commercial, illegal or improper content.
  • 12.3_The Website Administrator may delete any Posts that are older than a certain period of time and that no longer serve any purpose, with one (1) week prior notice.
Article 13 (Copyright of Posts)
  • 13.1_The copyright of the Posts posted by the Member in the Service shall belong to the writers of the Posts, and the Website Administrator may use them for other relevant services.
  • 13.2_In the event any of a Member’s Posts infringe upon a program or other copyright of a third party, the Member shall be solely liable for civil or criminal penalties for such infringement. In the event that this Website or the Website Administrator receives a complaint such as a claim for damages from a third party due to a Member’s infringement on the copyright or other rights, the Member shall endeavor to indemnify this Website and the Website Administrator, and the Member shall compensate all damages incurred by this Website and the Website Administrator therefrom.
  • 13.3_Posts posted by Members may be exposed in search results, Service or related promotions, and may be posted after partially modified, duplicated or edited within the scope necessary for such exposure. In such case, this Website complies with relevant provisions of the Copyright Act, and the Member may take measures such as deleting, excluding from search results or hiding..
  • 13.4_The Member may not commercially use or have a third party commercially use any materials posted in the Service, such as processing and selling any information obtained from the Service.
Article 14 (Ownership of Website Administrator)
  • 14.1_The Website Administrator shall own all intellectual property rights and other rights related to the Service provided by the Website Administrator, and any software, images, marks, logos, designs, service names, information and trademarks related thereto.
  • 14.2_The Member shall not, and shall not allow any third party to, modify, lease, loan, sell, distribute, produce, transfer, sub-license, pledge, or commercially use all or any of the above properties under paragraph (1) without express approval from the Website Administrator.
Article 15 (Notice to Member)
  • 15.1_The Website Administrator may notify the Member by sending a text message or electronic message to the phone number or sending an e-mail to the e-mail address registered by the Member.
  • 15.2_The Website Administrator may post a notice to all members on the bulletin board of this Website for more than seven (7) days to replace the notice in Article 15.1.

Chapter IV. Obligations of Parties

Article 16 (Member’s Obligations and Information Security)
  • 16.1_The Member shall not do any of the following acts:
    1. acts that harm others (including a small number of persons);
      • stealing the User ID, password, resident registration number of another person or impersonating another person;
      • falsely describing their relationship with another person;
      • acts that defame others by stating facts or falsehoods for the purpose of slandering others;
      • spreading false information to obtain monetary gain or cause damage to others;
      • interfering with another person’s daily life by repeatedly conveying words, sounds, texts, images, or videos that cause shame, disgust, or fear to such person;
      • using the Service for personal profit without prior approval from the Website Administrator; or
      • stealing the information of another person to use an information and communication service;
    2. posting unnecessary or unauthorized advertisements or promotional content, or posting or sending junk mail, spam, chain letters, or overposting or soliciting involvement in pyramid schemes;
    3. posting or sending by email vulgar or obscene data, text, software, music, photos, graphics or video messages (the “Inappropriate Content”);
    4. posting or sending by email any content that the Member has no rights to (intellectual property or other rights);
    5. posting or sending by email software viruses intended to destroy, interfere with or limit the functionality of computer software, hardware, or telecommunications equipment;
    6. posting or sending by email software viruses intended to destroy, interfere with or limit the functionality of computer software, hardware, or telecommunications equipment;
    7. gambling or engaging in speculative acts;
    8. soliciting prostitution or distributing any information encouraging adultery; or
    9. any other illegal acts or wrongdoing.
  • 16.2_Members shall comply with the provisions of these Terms of Use, relevant laws and announcements and notices of this Website. Additionally, Members shall not engage in any activity that interferes with the operation of this Website.
Article 17 (Web Administrator’s Obligations)
  • 17.1_The Website Administrator shall make available the Service on the date requested by the Member unless there are other special circumstances.
  • 17.2_The Website Administrator shall have the obligation to provide the Service in a continuous and stable manner in accordance with these Terms of Use.
  • 17.3_The Website Administrator shall be liable for loss or damage suffered by Members, provided that such loss or damage is caused by the willful conduct or gross negligence of the Website Administrator in connection with the Service. The scope of such liability shall be limited to general damages.
  • 17.4_The Website Administrator shall promptly accept and process any just opinion or complaint by Members, provided, however, if prompt processing of such opinion or complaint is not possible, the Website Administrator shall notify the Member of the reason therefor and the processing schedule thereof.
  • 17.5_The Website Administrator shall endeavor to protect the Personal Information of Members, including the information registered with this Website in accordance with the relevant laws and regulations. Article 17 shall apply mutatis mutandis to protection of the Personal Information of Members.
Article 18 (Personal Information Protection Policy)
  • 18.1_This Website shall collect the Personal Information of Members through the information they provide when applying to use the Service. The collected Personal Information of the Members shall be used for the purposes of performing the Use Contract and providing the Service under the Use Contract.
  • 18.2_The Website Administrator shall not divulge or distribute any Member information obtained in connection with provision of the Service to any third party without consent from the relevant Member, except where:
    1. required by a government agency for the purpose of a criminal investigation under the relevant laws;
    2. requested by the Information and Communication Ethics Committee; or
    3. requested in accordance with due process of other relevant laws.

Chapter V. Termination of Use Contract

Article 19 (Termination of Use Contract and Restrictions on Use)
  • 19.1_The Member may withdraw from membership (i.e. termination of the use contract) at any time if he/she no longer desires to receive the Service provided by this Website.
  • 19.2_When the Member applies for withdrawal from membership, this Website may check whether she/he is a Member, and this Website will process such application immediately in accordance with the relevant laws and regulations. However, the Website may prohibit the Member’s immediate withdrawal for a certain period of time after membership registration for reasons such as prevention of illegal use of the Service.
  • 19.3_The Website Administrator may terminate the Use Contract without prior notice in the event of any of the following:
    1. any information provided by the Member is found to be untrue;
    2. the Member is involved in criminal activity;
    3. the Member plans to use or uses the Service for the purpose of undermining the interest of the Website Administrator, the public interest, or the interest of any third parties;
    4. the Member uses the User ID or password of another person to access the Service;
    5. the Member defames or disadvantages another Member;
    6. the Member registers two or more concurrent User IDs with the Service;
    7. the Member damages the Service or otherwise interferes with its legitimate use; or
    8. the Member breaches any relevant laws or regulations set by the Website Administrator.

Chapter VI. Miscellaneous

Article 20 (Service Fee)

The Service shall be provided free of charge.

Article 21 (No Assignment)

The Member shall not assign, transfer, give, or pledge his or her right to use the Service or any other rights under the Use Contract.

Chapter VII. Indemnification

Article 22 (Liability for Damage)
  • 22.1_In the event that a Member violates these Terms of Use and causes damages to this Website due to such violation, the Member shall compensate all damages incurred by this Website and the Website Administrator.
  • 22.2_In the event that this Website or the Website Administrator receives complaints including claims for damages or lawsuits from a third party other than due to illegal acts or violations of these Terms of Use by the Member in using the Service, the Member shall indemnify the TCS in whole at his/her own costs, and the Member further shall compensate all damages incurred by this Website and the Website Administrator therefrom.
Article 23 (Indemnification)
  • 23.1_The Website Administrator shall not be responsible or liable for any failure to provide the Service due to acts of God or any other force majeure event.
  • 23.2_The Website Administrator shall not be responsible or liable for any failure to provide the Service due to reasons attributable to the Member.
  • 23.3_The Website Administrator shall not be responsible or liable for any loss of expected profit of Members in using the Service or any damage caused by materials obtained by Members from the Service.
  • 23.4_The Website Administrator shall not be responsible or liable for the reliability or accuracy of any information, data, or fact posted by Members in the Service.
  • 23.5_The Website Administrator is not obligated to intervene in disputes between Members or between Members and third parties arising out of Service, and is not responsible for compensation for damages caused therefrom.
Article 24 (Settlement of Dispute)

The Website Administrator and Members shall make all necessary efforts to amicably resolve any dispute between the Website Administrator and any Member in connection with use of the Service.

Addendum (Effective Date)

These Terms of Use shall enter into force on January 31, 2023.
